LEGAL AGREEMENT

Either you or It's a friendly match may terminate your membership in the service for any reason.

By registering and participating in It's a friendly match, you verify that you are at least 18 years old. You agree to abide by the following rules:

• You will treat emails and other information as private and will not forward that information without permission of the originator of the information.

• You will not harass others or use any vulgar, racist, or otherwise offensive language, either in public posted material or in private emails sent to other It's a friendly match members. You will not include in your profile any anatomical or sexual references or sexually suggestive and connotative language.

• You will not post any telephone numbers, street addresses, last names, URL's and/or email addresses in your profile.

• It's a friendly match reserves the right to edit photo submissions. Nudity and personal information in photos are unacceptable.

• You will not post advertisements or forward chain letters.

• You understand that other members are free to contact you. If you don't want other members to contact you, you can edit your settings to let It's a friendly match know that you don't want to receive mail from other members.

• You will not use any service provided by It's a friendly match to libel, defame, or slander any person, and you will not use any service provided by It's a friendly match to infringe on the privacy rights of any person.

• You will not post any information that infringes on the property rights of any person, including but not limited to the intellectual property rights of any person.

• You will not promote your profile outside of our system by using spam advertising.

• You will not promote any products or services to our members by using spam advertising through our system.

• If you choose to become a paying It's a friendly match member, you will be responsible for all charges incurred in accordance with stated prices and billing policies.

• Occasionally It's a friendly match offers a profile promotion service for a fee. Certain restrictions may apply.

• It's a friendly match may share user profile information with its subsidiary companies. Your information will still be considered private and will not be given out to 3rd parties.

• You assume full responsibility for all charges from other providers incurred in accessing the It's a friendly match service (such as online access providers, telephone service providers, or others).

It's a friendly match is not responsible for the use of any personal information that you may choose to disclose on this service. Please carefully select the type of information that you post on It's a friendly match or release to others.

It's a friendly match does not:

• Verify any information posted to the service or guarantee the proper use of such information by any party.

• Resolve disputes between service subscribers.

• Ensure that offensive material will be promptly removed from the service.

• Guaranty that you will receive a reply to the emails you send out.

• Ensure secure transmissions over the Internet.

It's a friendly match reserves the right to prohibit offensive language from the public areas of the service. It's a friendly match reserves the right but shall have no obligation to remove materials from the service that are not in compliance with this Service Agreement or the rules of It's a friendly match. It's a friendly match reserves the right to terminate service without notice to any user who fails to comply with this Service Agreement or the rules of It's a friendly match.

The It's a friendly match service contains proprietary information of It's a friendly match and its licensors. In addition, other persons may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, distribute, or sell any such information.

YOU AND OTHER PROVIDERS OF INFORMATION ARE THE PUBLISHERS OF THE INFORMATION CONTAINED ON It's a friendly match. IT'S A FRIENDLY MATCH IS NOT A PUBLISHER OF SUCH INFORMATION. IN NO EVENT WILL IT'S A FRIENDLY MATCH BE RESPONSIBLE FOR ANY INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR OTHER DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING ANY INTERRUPTIONS OF SERVICE, VIRUSES, POWER OUTAGES, OR COMMUNICATIONS BY OTHER SERVICE USERS.

It's a friendly match may choose to monitor the public areas of the service in accordance with any legal requirement, in order to maintain the service, and to protect the rights of service users.

Any unsatisfied customer can receive a refund upon demand.

You agree, at the request of It's a friendly match, to defend, indemnify, and hold harmless It's a friendly match, its officers, directors, employees, agents, and third parties, from your use of the service, including any violation of the rules contained in this Agreement or any accusation that the information that you post infringes on the intellectual property rights (such as copyright, trade secret, trademark, or patent) of any third party or that such information disparages, libels or invades the privacy of any third party.

IT'S A FRIENDLY MATCH PROVIDES THE SERVICE ON AN "AS-IS" BASIS WITHOUT WARRANTY OF ANY KIND, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CERTAIN JURISDICTIONS LIMIT THE APPLICABILITY OF WARRANTY DISCLAIMERS AND LIMITATIONS OF LIABILITY SO THE ABOVE DISCLAIMERS OF WARRANTY AND LIABILITY MAY NOT APPLY TO YOU.
